Terms of sale
Last updated:
Article 1 — Purpose and scope
These terms of sale govern the sale of digital content and the subscription offered in the Arena War game, available at arena-war.com, between the seller and any consumer player (“the Customer”). The game itself is free; purchases are optional. Any order implies acceptance of the terms in force on the day of the order.
Article 2 — Seller
TWK, sole proprietorship (micro-enterprise) of Mr Cyril Talbot
Registered office: 1 rue Marguerin, 75014 Paris, France
SIREN: 943 932 434 — registered with the Paris RCS
VAT not applicable, art. 293 B of the French Tax Code (CGI)
Email: contact@arena-war.com
Article 3 — Products
- Skins (characters, skins valid on all weapons, skins specific to one weapon): cosmetic items purchased once, linked to the Customer's account.
- Premium battle pass for a season (€9.99): unlocks the premium track of the current season and its rewards.
- VIP subscription (€4.99 per month, no commitment): +25% account XP, VIP badge next to the display name and two exclusive weapon skins usable while the subscription is active.
These items are cosmetic or grant XP bonuses: they confer no combat advantage. They are personal, non-transferable licences of use, with no monetary value, usable only in the game. A free player account is required to purchase.
Article 4 — Prices
Prices are shown in euros, all taxes included. VAT not applicable, art. 293 B of the CGI: no VAT is charged; the all-tax price equals the pre-tax price. The applicable price is the one displayed in the game at the time of the order. The seller may change prices at any time; a change to the VIP price applies to an ongoing subscription only after prior notice to the Customer, who may then cancel.
Article 5 — Order
The Customer, signed in to their account, chooses the item in the in-game shop, ticks the box requesting immediate performance and waiving the right of withdrawal (article 7), then is redirected to Stripe's secure payment page where they review the summary and confirm payment. The order is binding once payment is confirmed. An invoice is issued by Stripe for each payment and remains available from “Manage payments / invoices”.
Article 6 — Payment
Payment is made by bank card or other offered method, via the payment provider Stripe. Bank details are entered on Stripe's pages and are never transmitted to or stored by the seller. For VIP, the Customer authorises the monthly automatic charge on the registered payment method.
Article 7 — Immediate delivery and waiver of the right of withdrawal
Digital content is provided immediately after Stripe confirms payment: it appears in the account inventory (or the premium track / VIP status is activated).
Pursuant to article L221-28 13° of the French Consumer Code, the 14-day right of withdrawal cannot be exercised for the supply of digital content not supplied on a tangible medium where performance has begun after the consumer's express prior agreement and express waiver of the right of withdrawal. Before each payment, the Customer ticks the box: “I request immediate access to the digital content and expressly waive my 14-day right of withdrawal.” Without this box, payment is refused. This consent is recorded (date, account, item) and confirmed on the invoice sent by Stripe.
Article 8 — VIP subscription: duration, renewal, cancellation
The VIP subscription is concluded for one month, automatically renewed each month at the same price until cancellation. The Customer may cancel at any time, free of charge, from the “Manage payments / invoices” button (Stripe customer portal) in the game. Cancellation takes effect at the end of the monthly period already paid; benefits remain active until that date and no pro-rata refund is due.
If payment fails, Stripe retries; VIP stays active during the retry, then is suspended if payment does not succeed.
Article 9 — Refunds and payment disputes
Outside the right of withdrawal (article 7), a refund may be granted on a commercial basis in case of a lasting technical problem preventing use of purchased content: contact contact@arena-war.com.
A refund or payment dispute (chargeback) leads to automatic removal of the related content from the account (skin, battle-pass premium track and its rewards, or VIP status). If the dispute is decided in favour of the seller, the content is restored.
Article 10 — Legal guarantee of conformity
The seller must supply conforming digital content, pursuant to articles L224-25-12 et seq. of the Consumer Code. In case of a lack of conformity, the Customer may request conformity, or failing that a price reduction or termination of the contract, by contacting contact@arena-war.com.
Article 11 — Service availability and account
The game is provided online and may be interrupted for maintenance or updates. The seller endeavours to keep purchased content available for the duration of the game's operation. An account may be suspended in case of cheating, payment fraud or abusive behaviour; items attached to the account then remain linked to the account.
Article 12 — Personal data
Data necessary for the order is processed in accordance with the privacy policy.
Article 13 — Complaints and consumer mediation
For any complaint, the Customer first contacts customer service: contact@arena-war.com.
Pursuant to articles L612-1 et seq. of the Consumer Code, if that step fails (written complaint left without a satisfactory reply), the Customer may freely use the consumer mediator covering the seller, within one year of the written complaint:
[NOM, ADRESSE ET SITE INTERNET DU MÉDIATEUR DE LA CONSOMMATION À COMPLÉTER — adhésion obligatoire]
Article 14 — Governing law and disputes
These terms are subject to French law. Failing an amicable resolution, the dispute may be brought before the competent court; the consumer Customer may choose the court of the place where they lived when the contract was concluded or where the harmful event occurred.
